RULES AND REGULATIONS

 

 

1.      Ways to Enter the Contest.

NO PURCHASE NECESSARY.  To enter the “HEAT UP YOUR SUMMER WITH JACKSOUL” Contest (the “Contest”), enter on-line at www.click2music.ca/contests between June 29, 2004 and July 27, 2004. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Contest rules and regulations may be disqualified. Limit of one entry per person per email address. The Sponsors are not responsible for any lost, delayed, illegible, incomplete, misdirected, damaged or destroyed entries.

 

2.      Eligibility

The Contest is open to legal residents of Canada (except residents of Quebec), who have reached the age of majority in the jurisdiction in which they reside. Employees, officers, and directors (including immediate family members and members of the same household) of BMG Canada Inc., Best Buy Canada, Air Canada, Turtle Beach, a member of the Elegant Hotels Group in Barbados and the Barbados Tourism Authority (the “Sponsors”) and their respective affiliates and advertising agencies, and any other organizations associated with this Contest are not eligible to participate.

 

3.      Prize

One grand prize is to be awarded consisting of roundtrip air transportation for 2 from the international airport closest to the winner’s place of residence to Barbados, 5 nights all inclusive hotel accommodations (based on double occupancy) and access to the jacksoul performance while in Barbados (Approx. retail value $8000.00) (the “Prize”).  All transportation to and from the Toronto airport, ground transportation, departure tax, insurance, fuel charges, travel related fees and items of a personal nature, including but not limited to food, beverages, bar and wine charges, room service, gratuities and local and long distant telephone call, are the sole responsibility of the grand prize winner. Grand prize winner may be required to produce a valid and accepted credit card for check in at the hotel. Airflight in some parts of the country may require connecting flights. Food, beverages, bar and wine charges are subject to the policies of the Turtle Beach Resort. Grand Prize winner and their guest are solely responsible for obtaining and securing any and all documentation required to travel across International borders.  The Sponsors reserve the right to substitute the Prizes in whole or in part for something of equal or greater value in the event that any component of the Prize is unavailable. The Prize must be accepted as awarded and no substitutions, except as identified above, will be made. The Prizes may not be sold, transferred or assigned and are not convertible to cash.

 

4.      The Draw

The winner of the Contest will be selected in a random drawing conducted by BMG Canada Inc. of all eligible entries received by the Contest Closing Time. The odds of winning depend on the number of eligible entries received. The random drawing will take place on June 28, 2004 at BMG Canada Inc., 190 Liberty Street, Toronto, ON. In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill testing question and, no later than July 30, 2004, complete and return to BMG Canada Inc. a contest eligibility and liability/publicity release confirming his or her compliance with the contest rules and regulations, releasing the Sponsors and their respective directors, officers and agents from all liability, and permitting the Sponsors to use the selected entrant’s name and image, without compensation, in any publicity carried out by the Sponsors. In the event that an entrant is not eligible, is unable to answer the skill-testing question or cannot be contacted the evening of the draw, the Sponsors shall have the right to redraw another entrant as the applicable winner of the Prize and the Sponsors shall be released and discharged from any liability or responsibility in this regard.  No correspondence will be entered into except with the selected entrant. Entrants, by entering this contest, agree to abide by these rules and regulations, and that the decisions of the Sponsors are final. All entry forms entered become the property of the Sponsors and will not be returned.

 

5.      Internet

If for any reason the Internet entry portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsors reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of the entries. The Sponsors are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsors as a result of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to the entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.

 

 

 

6.      Information Provided

The Sponsors will be collecting data about you through the Contest Entry Forms. Any personal information will be handled in accordance with the privacy policy of the Sponsors.  The Sponsors intend to use this information for music marketing purposes.  By participating in the Contest, the entrant hereby agrees to such use.

 

7.      Disclaimer

The Sponsors reserve the right to withdraw, amend or terminate this Contest at any time without prior notice. The Sponsors also reserve the right to cancel this contest at any time because of any printing or other error, or if it suspects or finds evidence of tampering with any part of the Contest. The Sponsors shall not be liable for any errors or negligence that may arise or occur in connection with the Contest.  The Sponsors are not liable for injuries, death, damages or losses of any kind resulting from acceptance or use of the Prizes.

 

8.      Announcement of Winner

The name of the Grand Prize winner will be posted on www.click2music.ca beginning on July 30, 2004

 

9.      Subject to Applicable Laws

This Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
