1. Ways to Enter the Contest.
NO PURCHASE NECESSARY. To enter the “Britney Spears Curious” Contest (the “Contest”), fully complete and submit a Contest Entry Form online at http://www.click2music.ca after 12pm. EST on December 17, 2004 but no later than 11:59pm EST on January 3, 2005 (the “Contest Closing Time”). All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Contest rules and regulations may be disqualified. You can obtain a Contest Entry Form by accessing the website at http://www.click2music.ca. Limit of one entry per person per email address. The Sponsors are not responsible for any lost, delayed, illegible, incomplete, misdirected, damaged, destroyed entries.
2. Eligibility
The Contest is open to legal residents of Canada (except resident of Quebec), who have reached the age of majority in the jurisdiction in which they reside. Entrants under the age of majority are eligible to win provided that the prize winner’s parent or legal guardian accepts the prize on his or her behalf. Employees, officers, and directors (including immediate family members and members of the same household) of BMG Canada Inc. (hereinafter referred to as the Sponsors) and their respective affiliates and advertising agencies, and any other organizations associated with this Contest are not eligible to participate.
3. Prize
Five prize packs are to be awarded consisting of one (1) 50ml bottle of Curious Britney Spears and one (1) Britney Spears Greatest Hits: My Perogative – The DVD (Approx. retail value CDN$100) (the “Prize”). The Sponsors reserve the right to substitute the Prize in whole or in part for something of equal or greater value in the Sponsors’ sole discretion. The Prize must be accepted as awarded and no substitutions, except as identified above, will be made. The Prize may not be sold, transferred or assigned and is not convertible to cash.
4. The Draw
The winners of the Contest will be selected in a random drawing conducted of all eligible entries received by the Contest Closing Time. The odds of winning depend on the number of eligible entries received. The random drawing will take place on January 4, 2005 by a representative of BMG Canada Inc. at BMG’s Liberty Street office in Toronto, Ontario. The selected entrants will be notified by telephone or email within one (1) day of the draw. In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill testing question by phone and, within two (2) days, complete and return to the Sponsors a contest eligibility and liability/publicity release confirming his or her compliance with the contest rules and regulations, releasing the Sponsors and their respective directors, employees, officers and agents from all liability, and permitting the Sponsors to use the selected entrant’s name and image, without compensation, in any publicity carried out by the Sponsors. In the event that an entrant is not eligible, is unable to answer the skill-testing question or cannot be contacted after two (2) business days, the Sponsors shall have the right to redraw another entrant as the applicable winner of the Prize and the Sponsors shall be released and discharged from any liability or responsibility in this regard. No correspondence will be entered into except with the selected entrant. Entrants, by entering this contest, agree to abide by these rules and regulations, and that the decisions of the Sponsors are final. All entry forms entered become the property of the Sponsors and will not be returned.
5. Internet
If for any reason the Internet entry portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsors reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, the entries. The Sponsors are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsors as a result of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to the entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.
6. Information Provided
The Sponsors will be collecting data about you through the Contest Entry Forms. Any personal information will be handled in accordance with the privacy policy of the Sponsors. The Sponsors intend to use this information for future marketing purposes. By participating in the Contest, the entrant hereby agrees to such use.
7. Disclaimer
The Sponsors reserve the right to withdraw, amend or terminate this Contest at any time without prior notice. The Sponsors also reserve the right to cancel this contest at any time because of any printing or other error, or if it suspects or finds evidence of tampering with any part of the Contest. The Sponsors shall not be liable for any errors or negligence that may arise or occur in connection with the Contest. The Sponsors are not liable for injuries, death, damages or losses of any kind resulting from acceptance or use of the Prizes.
8. Announcement of Winner
The name of the Prize winners will be posted on the website located at: http://www.click2music.ca beginning on January10, 2005 and will remain posted until January 24, 2005.
9. Subject to Applicable Laws
This Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
